Dear Friends of Chaplain Corps Reform:
As you will see from this email, our attorney has filed a petition requesting that the US Supreme Court review our case. It is the final legal option that we have in our ongoing pursuit of legal action against the injustice perpetrated by the Navy Chaplain Corps.
It is my opinion as webmaster that this site has served a useful purpose, but it is time to bring this site to a close. Thanks to those of you who have prayed for us.

My last update reported I was in the process of finishing a petition for certiorari to the Supreme Court to review the D.C. Circuit’s egregious decision in our case last December.
The attached Petition was filed May 23, 2014, and placed on the Supreme Court’s docket May 28, 2014, Docket Number 13-1419. The Navy must respond by June 27.
The Petition attacks the D.C. Circuit’s: (1) unilateral change of our claim of denominational preferences to “disparate treatment”, a claim the D.C. Circuit manufactured without authority or support; (2) abandonment of the Establishment Clause’s neutrality mandate; and (3) adoption of the Fourth Circuit’s treatment of statistical factors the Supreme Court reversed in a case called Bazemore v. Friday. In abandoning Bazemore’s principles, the D.C. Circuit ignored its own Bazemore based precedent and adopted statistical litigation tactics it forbids to defendants in order to reject our statistics. This suggests the Circuit abandoned its role as an objective adjudicator to become an adversary.
Pages 13-15 of the Petition include a series of charts developed by Dr. Leuba showing the Chief’s influence on promotion over time to emphasize the issue is “denominational preferences”, not “disparate treatment”. Such charts are not normally included in a petition, but a picture is worth a thousand words and the considerable effort it took to include them.
I have said many times, “we wrestle not against flesh and blood, but against principalities, against powers, against the rules of darkness of this age, against spiritual hosts of wickedness in the heavenly places.” (Ephesians 6:12). Let us “put on the whole armor of God” and pray that the Lord bind the rulers of wickedness and deception, and move upon the hearts of the clerks and Justices who will review our petition to (a) recognize the great injustice done to His servants and the rule of law, and (b) grant the petition.
May the Lord of compassion, justice and mercy grant our petitions.
